Terms and Conditions of use of
the ETravelCafe Forum
The ETravelCafe Forum is provided
by MailDepo as a free service to the travel
community. Ideally the ETravelCafe Forum would not
need legal terms of use and for the most part,
ETravelCafe Forum users respect the law, MailDepo
and other users. We hope that these terms and
conditions of use will not suppress useful
discussion, but allow the ETravelCafe Forum to be
more useful for everyone.
This document is an agreement between you, as a user
or member of the ETravelCafe Forum and MailDepo,
Ltd. ("we", "us" or "our").
You are only permitted to use the ETravelCafe Forum
for personal, travel related, non-commercial
purposes. (In other words you will not be attempting
to advertise yourself or your agency/company.)
Your acceptance of these terms and conditions of
use, are indicated by your use of the ETravelCafe
Forum, whether participating or simply browsing. You
must read these terms and conditions of use
carefully before using the ETravelCafe Forum. We may
change these terms and conditions of use from time
to time so please check them regularly. We may
contact you via email to inform you of these changes
but are not required to.
If you have not completed a profile, you are not
permitted to make postings on the ETravelCafe Forum.

The ETravelCafe Forum is managed from Carlsbad,
California, if any legal issues should arise they
will be governed by the laws of San Diego County,
California, USA. Any illegal activity under the laws
of San Diego, California, while using the
ETravelCafe Forum is a violation of these terms of
use. Since the law as to the jurisdiction of online
systems is unsettled you must also consider the
possible effect of laws in jurisdictions outside of
California, possibly your country of residence as
well. As the ETravelCafe Forum is open to the travel
industry community worldwide you may run into legal
trouble in other jurisdictions over your postings.
If this happens you agree that you will not hold us
responsible for your postings.
In these terms and conditions of use, "post(s)" and
"postings" includes anything that you add to the
ETravelCafe Forum.
ETravelCafe Forum management
ETravelCafe Forum postings are
made without intervention from us. It is the
responsibility of EVERY USER to adhere to these
terms and conditions of use. In the interests of an
effective forum, we monitor postings and reserve the
right to remove, without notice, material which is
in breach of the wording or spirit of these terms
and conditions of use. We reserve the right, at our
discretion, to ban members who breach these terms
and conditions of use.
All users should be aware that postings are not
constantly screened by us, and that member postings
only represent the opinions and experience of that
member. POSTINGS DO NOT REPRESENT OUR OPINIONS OR
THE OPINIONS OF OUR TRAVEL PARTNERS! Be very careful
to rely on anything said in the ETravelCafe Forum.
If you do rely on information or opinion in any
posting you must be aware that you do so, on your
own volition and this is absolutely not our
responsibility. Please exercise common sense and
make your own inquiries.
You absolutely must not make postings of the
following nature (if you do, we may delete the
postings at our discretion, secondary offenders will
be banned):
racist comments;
sexist or homophobic comments;
harassing any other person;
defamatory statements or personal attacks on
others;
postings which disrupt other users' enjoyment of
the ETravelCafe Forum or which may or are intended
to detrimentally affect the operation of the
ETravelCafe Forum or the MailDepo web site; (One
example is the addition of persistent off-topic
discussion),
personal details or private information about any
other person (or anything contrary to our privacy
policy)
postings made under another person's name or
impersonating another person;
commercial advertising;
excessively coarse language;
content which would be rated R or X; or
postings which breach any law or discuss how to
commit illegal activity.
Use the right branch
We have divided the ETravelCafe Forum into different
categories for ease of finding information relevant
to their particular interests. It is important that
postings are made in the appropriate category. If
postings which are not relevant to a particular
branch are made, those postings may be deleted or
moved at our discretion.
Intellectual Property
The ETravelCafe Forum is about
the expression of ideas, but this must be done
within the law. It is very important that users
making posts, respect the intellectual property
rights of others. If you post material which has
been copied without permission you may put yourself
at risk of legal action. If this happens you agree
that you will not hold us responsible for your
postings.
You must not post copyrighted material or trademarks
without the permission of the owner.
If you wish to share a useful internet resource with
other ETravelCafe Forum users you should provide a
hyperlink to the relevant resource. If you do this
you need to be aware that many site operators do not
permit people to link to their site, so before
posting a hyperlink on the ETravelCafe Forum you
should check the terms of use of the other web site
to see if your hyperlink is permitted.

infringed through a user posting, please contact us

By posting in the ETravelCafe Forum you agree that
you license your copyright in postings to MailDepo.
In general users own copyright in their postings.
From time to time, we may use ETravelCafe Forum
postings in our marketing (email broadcasts,
newsletters, web sites, other print and digital
publications, and products in any other media).
Therefore you agree to give us a non-exclusive,
perpetual, irrevocable, royalty-free, worldwide
license to use your postings by reproducing,
communicating, re-publishing, editing or otherwise
exploiting the postings as we see fit. You also give
us a license to deal with the postings as necessary
to perform technical and administrative functions in
managing the ETravelCafe Forum. You also grant us
the right to sub-license your postings (or modified
versions of the postings) to others at our
discretion. Once you have made a posting on the
ETravelCafe Forum, you consent to us dealing with it
as we see fit. You cannot withdraw or retract the
posting or seek payments from us in relation to this
license at any time in the future. If you do not
want your material to be used in this way you must
not post it on the ETravelCafe Forum. If we do use
your material we may attribute it to your screen
name (first name and last initial), but we are not
required to. We will never publish your real name.
With respect to your rights in your postings, you
consent to your postings being used, transmitted,
exhibited, copied, published, communicated or
adapted as we see fit. Understand that we generally
attribute authorship, but it is not always possible.
You consent to us not attributing authorship to you
at all, or only attributing it to your ETravelCafe
Forum screen name. If we elect to attribute
authorship we will make reasonable efforts to
attribute authorship to your screen name, but should
a mistake be made and authorship is falsely
attributed, you consent to that false attribution
(in such circumstances).
Third parties are NOT permitted to copy, or transmit
postings without permission. Permission can be
obtained from the user or from us as licensee. If

The ETravelCafe Forum content (other than postings),
copyright is held or licensed by us. You may not
reproduce this content without permission from the
relevant copyright owner or licensee. You must not
use the MailDepo or ETravelCafe Forum trademarks for
any purpose without our permission.
Content contained in the ETravelCafe Forum may not
be suitable for people under 18, since users can
post directly to the ETravelCafe Forum, it may
contain content of questionable or sensitive nature.
The ETravelCafe Forum is intended for the travel
community and not for children. While we hope that
they content is not offensive, we do not intend for
children to read or post. If you are concerned about
the appropriateness of content posted on the
ETravelCafe Forum please refer the complaint to us.

Please review the MailDepo web
site Privacy Policy regarding your profile
information, otherwise you must understand that your
postings can be read by every one visiting the
MailDepo site. If you share items of a personal
nature they will be available for others to see.
With your permission, we may disclose information
about you to our partners.
Complaints Procedures
If you become aware of a posting
that you believe is infringing your legal rights
(including copyright, trade mark, defamation and
others) you should immediately make us aware of the
posting. We will investigate all complaints and may
at our discretion take action, (from removing the
post, or removing all the postings by that user, or
banning that user from the ETravelCafe Forum.
To make a complaint, contact the administrator via
email at post@maildepo.com and point out the
category in which the offensive post is located. Be
aware that removal of postings is fully at our
discretion, except if the content is illegal. If you
are not happy with the action taken, you can follow
the formal complaints procedure set out below. We
may also require you to follow the formal procedure
for certain matters (for example, if you claim that
content is infringing copyright or is defamatory).
The formal procedure
1. By email please identify the post, including
the category, screen name and date. In the subject
line of the Email please type ETravelCafe Forum
Complaints.
2. Identify the infringement or law that you feel is
in issue. Intellectual property or other right or
the law which the posting breaches. Please
articulate your arguments about this as thoroughly
as possible.
3. Provide information so that we can contact you
directly.
4. As formality requires please include the
following statement: "I swear, under penalty of
perjury, that the information in this complaint is
accurate".
5. Should the issue move further we will request of
you that you sign and date the paper and send it by
facsimile or postal service. In this event, the
information will be provided so that you may do so.
If you wish to make it this formal please inform us
of this fact in your email complaint.
We will review your complaint upon receipt and will
take whatever action we see fit, based on the merit
of your complaint and the evidence provided. No
matter the course we decide on, we will contact with
you to explain our decision.
Liability and Indemnities
We are not responsible to you or
anyone else for any loss, damage, liability, cost or
expense suffered in connection with the use of the
ETravelCafe Forum or any of its content. We make no
warranties or representations about it or its
content. We exclude, to the maximum extent permitted
by law, any liability which may arise as a result of
the use of the ETravelCafe Forum, its content or the
information available on it. Where liability cannot
be excluded, any liability incurred by us in
relation to the use of the ETravelCafe Forum or its
content is limited to the re-supply of the service
or the cost of having the service provided again (at
our discretion). We will never be liable for any
indirect, incidental, special or consequential loss,
or loss of business profits or revenue arising from
the use of the ETravelCafe Forum.
You must indemnify us and the other companies
(Suppliers) using MailDepo services, against each
claim, proceeding, judgment, action, loss, damage,
expense or liability incurred or suffered by, or
brought, made or recovered against us or the other
companies using the MailDepo services in connection
with any breach of these terms and conditions of
use.
